moemate is an AI companion application ("moemate", "Application", "we", "us", or "our"). Please read these Terms of Service ("Terms") carefully before using the moemate Application. By accessing, using, or registering for an account with moemate, you agree to be bound by these Terms.

Scope of Services

moemate is an entertainment product designed to provide users with a virtual AI companion for amusement purposes only. The Application is not intended for any other purpose, including but not limited to medical, psychological, or professional advice or consultation.

User Requirements

To use moemate, you must be at least the minimum age required in your jurisdiction to enter into a legally binding contract. By accessing or using moemate, you represent and warrant that you meet the minimum age requirement.

Privacy and Data Protection

Intellectual Property

All intellectual property rights in moemate, including but not limited to its design, features, functionality, and content, are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use moemate for your personal, non-commercial use, subject to these Terms.

User Conduct

You agree to use moemate only for lawful purposes and in compliance with these Terms. You are solely responsible for your conduct while using moemate and any content you create, transmit, or display. You agree not to engage in any activity that may harm moemate, its users, or any third parties.

We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that moemate will meet your requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected.

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use moemate.

Indemnification

You agree to indemnify, defend, and hold harmless moemate, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of moemate.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which moemate is based, without regard to its conflict of law provisions.

Changes to the Terms

We reserve the right to modify or update these Terms at any time and at our sole discretion. We will notify you of any changes by updating the "Last Updated" date at the beginning of these Terms. Your continued use of moemate constitutes your acceptance of the amended Terms. If you do not agree to any changes, you must discontinue your use of moemate.

Limitations of AI Language Model (LLM)

moemate is based on an AI Language Model (LLM), which is a machine learning model designed to understand and generate human-like text based on the data it was trained on. While LLMs can provide a rich and engaging user experience, they are not infallible and may occasionally generate content that is incorrect, outdated, or inappropriate.

Information Accuracy Disclaimer

We strive to ensure that the information provided by moemate is accurate and up-to-date. However, due to the nature of AI language models, we cannot guarantee the accuracy, completeness, or timeliness of the information generated by moemate. You acknowledge and agree that any reliance on the information provided by moemate is at your own risk, and we disclaim any liability arising from any inaccuracies or omissions in the information generated by moemate.

Unintentional Sensitive Conversations

While moemate is designed to provide an entertaining and enjoyable user experience, there may be instances when the AI chatbot unintentionally leads a conversation down a sensitive or painful path for the user. We acknowledge that this may cause discomfort or distress, but please be aware that any such occurrence is strictly unintentional. If you feel triggered or uncomfortable during a conversation with moemate, it is your responsibility to discontinue the use of the service. We are not liable for any emotional distress or harm caused by the AI chatbot's conversation.

Cancellation and Refund Policy

As a subscriber to moemate, you have the right to cancel your subscription at any time. If you choose to cancel your subscription within 48 hours of signing up and have used less than 10% of your allotted messages during this period, you will be eligible for a full refund. To request a cancellation of your subscription and a refund, please contact us at helpdesk@moemate.io. The refund will be credited back to the original payment method used during the purchase. It may take up to several business days for the refund to appear on your statement, depending on your financial institution. Please note that canceling your subscription will result in the loss of access to the moemate service from the next billing cycle.
